1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of F5Type, including the F5Type website, desktop and mobile applications, and related services.

By creating an account, purchasing F5Type, activating an AppSumo licence, downloading the application, or otherwise using F5Type, you agree to these Terms.

If you do not agree with these Terms, do not use F5Type.

2. About F5Type

F5Type is an AI dictation application. Its primary functionality allows you to press a shortcut (F5 by default on Mac), speak naturally, and have F5Type convert your speech into clean text and insert it at your cursor.

F5Type is available for macOS, Windows, iOS and Android. The F5Type website provides product information, support and AppSumo licence activation.

3. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use F5Type.

If you use F5Type on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

4. Your Account

You are responsible for:

• Providing accurate account information
• Maintaining access to your account
• Keeping authentication information secure
• All activity performed through your account

You must not share, sell, or transfer your account in a manner that violates your applicable plan or these Terms.

5. Acceptable Use

You agree not to use F5Type to:

• Violate applicable laws
• Infringe another person's intellectual-property rights
• Attempt unauthorized access to F5Type or its infrastructure
• Circumvent usage limits or access controls
• Abuse or deliberately overload the service
• Use F5Type to distribute malicious software
• Bypass subscription, AppSumo, or authentication controls

We may suspend or terminate accounts involved in serious abuse or security violations.

6. Your Content

You retain ownership of content you provide to F5Type, including your recordings, transcripts, dictionary entries, snippets, and other content you create.

You grant F5Type the limited rights necessary to process, store, transmit, synchronize, and display that content solely to provide the services you request.

F5Type does not claim ownership of your dictated content.

7. AI-Generated Output

F5Type uses automated speech recognition and AI processing. AI-generated or transformed output may occasionally contain errors.

You are responsible for reviewing generated text before relying on it, especially for legal, financial, medical, business-critical, or other high-consequence uses.

F5Type does not guarantee that AI-generated text will always be accurate.

8. No Loss Guarantee

F5Type is designed around a "never lose a word" reliability principle. Recordings are saved locally before cloud processing, and failed jobs are intended to remain available for retry.

However, while we design the service to minimize data loss, we do not guarantee that data will never be lost under every possible hardware, software, operating-system, storage, network, or third-party failure.

Users should maintain appropriate backups of information that is important to them.

9. Plans and Subscriptions

F5Type currently offers a Free plan and paid Pro plans.

Paid Pro usage is subject to the applicable fair-use requirements.

We may change pricing or plans in the future, subject to applicable law and the terms of your existing purchase.

10. AppSumo Purchases

F5Type may be offered through AppSumo lifetime-deal promotions.

AppSumo users activate their entitlement by activating their AppSumo licence on the F5Type website and linking it to one F5Type account.

The applicable AppSumo offer and the licence tier you hold determine the entitlement associated with your licence. Tier changes and refunds made on AppSumo apply to your F5Type account automatically.

AppSumo licences may only be activated according to the applicable AppSumo offer and F5Type's activation rules. A licence can be linked to only one F5Type account.

We may reject invalid, refunded, fraudulent, or already-activated licences.

11. Payments

Subscriptions bought in the iPhone or Android app, or in the Mac app from the Mac App Store, are processed by Apple or Google and are also subject to their terms. You manage or cancel those subscriptions through your Apple or Google account.

Subscriptions bought directly from F5Type, such as in the Windows app or the Mac app downloaded from our website, are processed through Stripe.

Stripe may provide a customer portal for eligible subscription management.

AppSumo lifetime licences are purchased on AppSumo, as described in section 10.

Your subscription status may affect your access to paid F5Type functionality.

12. Third-Party Services

F5Type works alongside third-party apps and services, such as the apps you dictate into, app stores, and payment providers.

Your use of those services is subject to their own terms and policies. F5Type is not responsible for third-party services that it does not control.

13. Software License

Subject to these Terms and your applicable plan, F5Type grants you a limited, non-exclusive, non-transferable right to install and use the F5Type software for your permitted use of the service.

You may not:

• Resell the software
• Distribute unauthorized copies
• Remove proprietary notices
• Circumvent licensing or entitlement controls
• Abuse protected functionality to build a competing product

14. Intellectual Property

F5Type and its associated software, branding, interfaces, documentation, designs, and technology are owned by or licensed to HAPDAY - FZCO and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of F5Type intellectual property to you.

15. Service Availability

We aim to provide a reliable service, but F5Type may occasionally be unavailable because of maintenance, software updates, infrastructure failures, network failures, third-party service outages, security incidents, or events beyond our reasonable control.

We do not guarantee uninterrupted or error-free availability.

16. Suspension and Termination

We may suspend or terminate access if:

• You materially violate these Terms
• You engage in fraud or abuse
• Your account presents a security risk
• Required by law
• You attempt to circumvent licensing or entitlement controls

Where appropriate, we may provide notice and an opportunity to resolve the issue.

17. Disclaimer of Warranties

To the maximum extent permitted by law, F5Type is provided on an "as is" and "as available" basis.

We do not guarantee:

• Perfect transcription accuracy
• Perfect AI cleanup
• Compatibility with every application
• Uninterrupted availability
• Error-free operation
• That every dictated word will always be correctly recognized
• That every third-party application will accept automated text insertion

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, HAPDAY - FZCO will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of F5Type.

Where liability cannot legally be excluded, it will be limited to the maximum extent permitted by law.

19. Indemnification

To the extent permitted by law, you agree to defend and indemnify F5Type and its officers, employees, contractors, and affiliates against claims arising from:

• Your unlawful use of F5Type
• Your violation of these Terms
• Your infringement of another person's rights
• Your misuse of the service

20. Changes to the Service

We may add, modify, or remove features from F5Type. We may also update the service to improve security, reliability, performance, or functionality.

21. Changes to These Terms

We may update these Terms from time to time. If material changes are made, we may provide reasonable notice through the website, application, or email.

Your continued use of F5Type after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

22. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws applicable in the Emirate of Dubai and the United Arab Emirates.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of F5Type shall be subject to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates, unless applicable law requires otherwise.
